2. Intellectual Property & Digital License Usage

When you purchase a digital embroidery design file from Amer Embroidery Studio, you are purchasing a license to use the design, not ownership of the design file itself. All copyrights and intellectual property rights remain exclusively with Amer Embroidery Studio.

What You CAN Do (Allowed Commercial Use):

• You may stitch our designs onto physical items (such as clothing, towels, bags, hats, etc.) for personal use or to sell for a profit as part of your physical-goods business.

What You CANNOT Do (Prohibited Use):

• You may not share, copy, gift, trade, resell, sub-license, or distribute the digital files (or any part of the files) in any format, to anyone, for any reason.

• You may not convert our embroidery files into other vector formats (like SVG, PNG, EPS) to sell or distribute them as graphic design elements.

• You may not use our product listing photos, mockups, or digital renders on your own website or shop to advertise your physical products without explicit written permission. You must stitch out the design yourself to photograph it for your shop.

3. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers/expiration dates, so that we can complete your transactions and contact you as needed.

4. Digital Delivery & Modifications to Prices

• Delivery: All designs are instant digital downloads. Once payment is processed, a download link will be provided on the confirmation page and/or sent via email.

• Prices: Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

5. Disclaimer of Warranties; Limitation of Liability

• We do not guarantee, represent, or warrant that your use of our service or files will be uninterrupted, timely, secure, or error-free if used with incompatible third-party software or faulty embroidery hardware.

• We highly recommend test-stitching designs on a scrap piece of fabric before stitching onto your final garment. In no case shall Amer Embroidery Studio, our directors, or employees be liable for any injury, loss, claim, or any direct/indirect damages of any kind—including, without limitation, ruined garments, broken needles, thread breaks, or machine damage—arising from your use of our digital files.

6. System Logs & Account Security

We monitor download activity on our backend system to ensure compliance with our licensing agreements and to prevent unauthorized distribution. Accounts displaying suspicious download behavior (e.g., massive concurrent downloads from multiple geographic IP locations) may be flagged, suspended, and reviewed for copyright violations.

7. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the jurisdiction in which Amer Embroidery Studio operates.
